Whistleblowing and prevention of corruption in Italy and the USA

On Wednesday, May 6, at 3 p.m. in the Viale Pola campus, LUISS will host a conference entitled Whistleblowing and preventing corruption. The American experience and the new Italian regulations.

The meeting, coordinated by Paola Severino, professor of Criminal Law and Vice Provost at LUISS University, will analyze the effect of new Italian laws on crimes of fraud and corruption and aims to identify incentives and forms of protection to defend sources and ensure veracity of information, in both public and private sectors.

The whistleblower appears in Italian civil law with the approval of the so called Anti-corruption Law (n. 190/2012) that, for the first time, introduces a form of protection for civil servants reporting misconduct in the workplace. The theme is already recognized in Common law legal systems and in the United States, where it has contributed to discover important cases of illicit business.

The meeting will compare American and Italian experiences thanks to the partecipation of John R. Phillips, American Ambassador in Italy and one of the authors of the False Claim Act, which allowed the US Department of the Treasury to recover over 55 billion dollars from 1986 to present.

The meeting will be attended by Giuseppe Pignatone, Italian chief prosecutor, Raffaele Cantone, President of the National Anti-Corruption Authority, and Giuseppe Recchi, President of Telecom Italia.
